AGC Construction Education Foundation (“AGC CEF”or “We”) respects your privacy and is committed to protecting it through our compliance with this policy. AGC CEF’s primary objective in collecting user information is to provide the best member and customer service possible. AGC CEF collects information on the Website to provide educational and career development and advancement resources to those who request it and/or provide data. We use information that we collect about you or that you provide to us, including any personal information, to present our Website and its contents to you, to provide you with this information, products, resources, or services, to fulfill any other purpose for which you provide it, to provide you with notices about your account, to carry out our obligations and enforce our rights arising from any contracts entered into between you and us (e.g., billing and collection), to allow you to participate in interactive features on our Website, in any other way we may describe when you provide the information, or for any other purpose with your consent.

We may disclose personal information that we collect or you provide as described in this privacy policy with AGC CEF chapters and third parties, for the purpose of providing products, services, and resources offered by AGC CEF. AGC CEF occasionally shares some collected information with member and nonmember individuals and entities. AGC CEF generally does not sell or trade collected information to third parties specifically for commercial use.We do not control third parties’ collection or use of your information to serve interest-based advertising. However these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s website.

You can review and change your personal information by logging into the Website and visiting your personal account profile page. You may also send us an email at info@buildcalifornia.com to request access to, correct, or delete any personal information that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

The Children’s Online Privacy Protection Act of 1998 and its rules (collectively, “COPPA”) require us to inform parents and legal guardians (as used in this section, “parents”) about our practices for collecting, using, and disclosing personal information from children under the age of 13 (“children”). It also requires us to obtain verifiable consent from a child’s parent for certain collection, use, and disclosure of the child’s personal information. This section only applies only to children under the age of 13 and supplements the other provisions of this privacy policy.

The target audience for AGC CEF’s Build California program, and the resources, services and products provided by the Build California program, is individuals ages 12-24. Children can access many parts of the Website and its content and use many of its features without providing us with personal information. However, some content and features are available only to registered users and/or require us to collect certain information, including personal information, from them. In addition, as explained above, we use certain technologies, such as cookies, to automatically collect some information from our users (including children) when they visit or use the Website. We only collect as much information about a child as is reasonably necessary, and we do not condition his or her participation on the disclosure of more personal information than is reasonably necessary.

A child must provide us with certain information to register with this Website and/or we may request certain information from a child to provide the resources, services and products of the Website, including name, birth date, subject interests, contact information (e.g., email address and/or telephone number) and a parent’s email address. We may also require the child to create a member name and password. We may request additional information from your child as is reasonably necessary. We specify whether information is required or optional when we request it.

We use technology to automatically collect information from our users, including children, when they access and navigate through the Website and use certain of its features. The information we collect through these technologies may include the user’s domain name, IP address, and certain information about the user’s equipment (e.g., type of browser, screen resolution, support of Java). Our server does not automatically record or recognize user-specific, personal information.

The purpose of data collection (including collection of data from a child) is to provide educational and career development and advancement resources to those who request it and/or provide data. AGC CEF uses the personal information we collect from your child, and shares some such information with AGC CEF chapters and third parties, for the purpose of executing these products, services, and resources. AGC CEF occasionally shares some collected information with member and nonmember individuals and entities. AGC CEF generally does not sell or trade collected information to third parties specifically for commercial use. However, AGC CEF reserves the right to sell or trade collection information with any third party with consent by you (or in the case of a child, with consent of the parent(s)).

 

We use the information we collect automatically through technology (see Automatic Information Collection) and other non-personal information we collect to improve our Website and to provide the best services and resources possible.

 

  1. Accessing and Correcting Your Child’s Personal Information

At any time, you may review the child’s personal information maintained by us, require us to correct or delete the personal information, and/or refuse to permit us from further collecting or using the child’s information.

Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website. Absent user consent, AGC CEF does not knowingly share credit card numbers with third parties except to the extent necessary for, and incidental to, the purposes for which the user supplied the information.

  1. Personal Information Sales Opt-Out and Opt-In Rights

If you are 16 years of age or older, you have the right to direct us to not sell your personal information at any time (the “right to opt-out”). We do not sell the personal information of consumers we actually know are less than 16 years of age, unless we receive affirmative authorization (the “right to opt-in”) from either the consumer who is between 13 and 16 years of age, or the parent or guardian of a consumer less than 13 years of age. Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize personal information sales. However, you may change your mind and opt back in to personal information sales at any time by sending an email to info@buildcalifornia.com.

You do not need to create an account with us to exercise your opt-out rights. We will only use personal information provided in an opt-out request to review and comply with the request.
